Terms of Service for AllFives Review Management Platform

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and AllFives ("we," "us," or "our"), concerning your access to and use of the AllFives review management platform, website (https://allfives.app), and related services (collectively, the "Services").

By accessing or using our Services, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use our Services.

2. Description of Services

AllFives is a review management platform designed to help businesses control, filter, and maximize their online reviews. Our Services include, but are not limited to:

  • Creation of branded review collection pages
  • Star rating collection
  • Customer feedback forms
  • QR code generation
  • Review filtering
  • Email notifications
  • Analytics and reporting

3. Account Registration and Security

To access certain features of the Services, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to update such information to keep it accurate, current, and complete.

You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

4. Subscription Plans and Payment

4.1 Subscription Tiers

AllFives offers various subscription plans, including Free, Pro, and Agency tiers, each with different features and limitations as described on our pricing page. We reserve the right to modify our subscription plans and pricing at any time.

4.2 Payment Terms

All paid subscriptions require payment in advance. By providing payment information, you authorize us to charge your payment method for all fees incurred. All payments are non-refundable unless otherwise stated.

4.3 Subscription Renewal

All paid subscriptions automatically renew until cancelled. You may cancel your subscription at any time through your account settings or by contacting support@allfives.com.

5. User Content and Conduct

5.1 User Content

"User Content" refers to any information, data, text, or other materials that you upload, submit, or display through the Services. By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing the Services.

5.2 Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Attempt to manipulate reviews through fake submissions or incentives
  • Engage in "review gating" (selectively soliciting only positive reviews)
  • Impersonate any person or entity
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any portion of the Services
  • Use the Services to transmit viruses, malware, or other harmful code
  • Scrape, crawl, or use automated means to access the Services
  • Modify, adapt, or hack the Services or modify another website to falsely imply association with AllFives

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALLFIVES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

You agree to indemnify, defend, and hold harmless AllFives and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your use of the Services or violation of these Terms.

These Terms shall remain in full force and effect while you use the Services.

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

These Terms shall be governed by the laws of the jurisdiction in which AllFives is established, without regard to its conflict of law provisions.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

The failure of AllFives to enforce any right or provision of these Terms will not be considered a waiver of those rights.
